This is former Ellis County Sheriff Chuck Edge. He is a bad, bad man. John Eric Armstrong has been in solitary confinement in the Ellis County Jail for over a year without a trial anywhere in sight. John Eric Armstrong has never been convicted or charged with a crime before -- not even now. It's an incredible story - Part 3.
This is John Eric Armstrong - Ellis County Texas Corruption Victim - Part 3 -- His story in his words:
False Arrest July 9, 2019 (Sgt. Joe Fitzgerald, Patrol Sgt Jerry Whitt, Deputy Mike McKenna, and Lt. Shane Thompson)
Lauren Kersh’s brother Sergeant Joe Fitzgerald (Sgt. over investigations and the public information officer) arrested me without probable cause to stop me from filing a police complaint against his sister. I say this is Joe Fitzgerald’s arrest because he ordered the report against me in his official capacity without an accusation of any crime (probable cause) however, he does tell dispatch about his sister pulling a gun on me (aggravated assault). There was no call for service (no one called 911). Instead, Sgt. Joe Fitzgerald called his coworkers and friends and ordered dispatch to send a deputy to his sister’s house to take a report against me with the intent to have me arrested. Joe Fitzgerald arrested me by proxy, which is to say he had other officers take a report and make an arrest on his behalf using Joe Fitzgerald’s word for their report.
It is detailed in the video evidence that Joe Fitzgerald sent his family friend (Patrol Sgt. Jerry Whitt) to accompany the deputy Joe Fitzgerald ordered dispatch to send. The video evidence makes it clear that Joe sent the deputies to charge and arrest me for stalking without probable cause. This is made clear by Jerry speaking (on camera) about the conversation between Joe Fitzgerald and him concerning what they can charge me with. Jerry Whitt speaks about his conversation with Joe Fitzgerald several times. He makes it clear that Joe is the go-to guy on this.
Joe Fitzgerald can’t give Dispatch a reason (probable cause) to send a deputy to his sister’s house to take a report against me. Joe Fitzgerald doesn’t have a reason because his sister is the one who did something wrong. Joe Fitzgerald vilifies me by lying (making false statements) to make it sound like I may be a shady person. Including Joe Fitzgerald’s false statements about me, Joe never accused me of a crime. Even to this day, I have never been accused of a crime. They either select a charge and fill the report with excuses (false statements) for why they think they should be allowed to arrest me without probable cause or they simply don’t charge me at all and hide their arrest behind old paperwork that has been dismissed.
On June 9, 2019, Deputy Mike McKenna and Patrol Sargent Jerry Whitt (Joe’s family friend) go to Lauren Kersh’s house and take a false report/false witness statement from Lauren Kersh to make a false arrest on Joe’s behalf. As they conspire for nearly an hour on camera, Mike McKenna and Jerry Whitt talk to Lauren Kersh about Jerry Whitt’s earlier conversation with Joe Fitzgerald concerning what they could charge me with (conspiracy, fraud). Lauren Kersh confesses over and over to pulling a gun on me and threatening to kill me in the video recordings however, both Mike McKenna and Jerry Whitt are completely oblivious to her repeated confessions. On camera, Lauren Kersh accuses me of returning to her home after being told not to come back however, she is caught in her lie later in the report (she never told me not to come back). For the most part, Lauren Kersh stands around bad-mouthing (lying about) me, saying anything she can to justify what she did. When she’s not bad mouthing me, she’s confessing to pulling a gun on me and threatening to kill me. Jerry Whitt, Mike McKenna, and Lauren Kersh conspire for nearly an hour trying to come up with probable cause to charge me with anything that might justify Lauren Kersh’s aggravated assault. By the end of their visit, they still don’t have probable cause against me for anything. Even so, Mike McKenna hands Lauren Kersh a card that says stalking/harassment and tells her that is what it’s going to be.
Jerry Whitt coached Lauren Kersh regarding fear. Lauren Kersh never mentioned fear until Jerry Whitt brought it up. They spoke about me going to the Waxahachie Daily Light twice on camera in Lauren Kersh’s home. Jerry Whitt greeted Lauren Kersh’s son by name when he arrived and gave Lauren Kersh a great big hug when he left (conspiracy). That these deputies would even try to arrest the victim of a violent crime is illegal.
My Apartment June 9, 2019
Patrol Sgt. Jerry Whitt and Deputy Mike McKenna came to my apartment on June 9, 2019 right after they took their false report from Lauren Kersh. These deputies came to my apartment without a call for service from anyone. The Sheriff, Chuck Edge, later stated in my termination letter that these deputies came to visit with me. This was no visit; they were sent on Joe Fitzgerald’s behalf to stop me from filing a complaint with the police. They made it clear that I was being detained as I asked if I could go turn off my stove, and they told me “no.”
They were there to get me before I got them. Patrol Sgt. Jerry Whitt was wearing the body camera during the conversation. Jerry Whitt splits and withholds the beginning of our conversation from the video evidence. They withheld this portion of the conversation because it contained my witness statement about Lauren Kersh pulling a gun on me and threatening to kill me and the deputies’ reason for coming to my apartment (coercion). Click here to see the edited video from Jerry Whitt's bodycam on June 9, 2019.
Jerry Whitt and Mike McKenna motioned for me to come over to them. They were parked in front of my apartment building, and I went to my car to get something. They asked me if I knew why they were there. I told them I figured Lauren Kersh called her brother and her brother sent them. Mike McKenna smiled and said, “pretty much.” At first, it was implied that Mike McKenna and Jerry Whitt were Joe Fitzgerald’s friends who came to speak to me about a personal matter (not an official call).
Jerry Whitt asked about Lauren Kersh threatening to kill me saying, “and she pulled a gun on you?” I replied, “yeah.” He asked, “how was that?” And I replied, “not very fun.” Jerry Whitt then said, “now she asked you not to come back though, right?” I replied, “no, she never told me not to come back. I just knocked on her door, and she pulled a gun on me and said she would kill me.” This is the end of the withheld portion of video. The rest of the conversation is recorded.
The video edit is proven by the way that the police-worn Axom body camera works. The Axom records a 30-second buffer period before a police officer begins to record in which the camera records video but not audio. Both deputies’ cameras were working correctly as evidenced in the videos recorded earlier on this day at Lauren Kersh’s house (the 30-second buffer period worked). The 30-second buffer period from Patrol Sgt. Jerry Whitt’s body camera is missing from the State’s Discovery evidence for this case (posted on Youtube), proving that the video was split and is being withheld (it didn’t just get up and walk off or vanish into thin air.) The Discovery evidence does contain a short clip but it is not the beginning as the 30-second buffer period is missing from it as well.
Jerry Whitt cuts off his camera and begins recording again. As they begin recording, they talk to me as a suspect, saying “I don’t know what y’all got going on out there but, she doesn’t want you back.” They now treat this like an official call saying that they were called and they have to make a report (there was no call for service). Additionally, they spoke to me like they were my supervisors as we all worked for the Ellis County Sheriff’s Office. They went on to issue a criminal trespass warning even though we just talked about Lauren Kersh pulling a gun on me and threatening to kill me.
The deputies don’t speak to me about any crime on camera because they already did in the withheld portion of the video (they talk about Lauren Kersh’s crime). They never accuse me of a crime, but they suggest that I’ve done something wrong by going to Lauren Kersh’s house. They said that I would have to talk to an investigator the following week (never happened) and that I’ll likely be fired. They talk about how great Sheriff Chuck Edge is, and they talk about me going to the Waxahachie Daily Light. They make clear that I am being detained when I asked if I could go turn off my stove and they told me no.
The only lawful reason these deputies had to come to my apartment was to ask me if I wanted to press charges on Lauren Kersh, though they had a duty to arrest her anyway. Joe Whitt never wrote a report, and the deputies who took his report never mention Joe Fitzgerald in their report or that his sister pulled a gun on me and threatened to kill me. My statements about Lauren Kersh pulling a gun on me and threatening to kill me are removed from the video evidence, and there is no mention of my statements in their reports. They didn’t have probable cause to arrest me for stalking on the 9th but they wrote reports against me anyway without an arrest.
The Ellis County Sheriff’s Office can’t do what they did. They came out to my apartment and issued a criminal trespass warning against me under threat of death. Lauren Kersh just pulled a gun on me and threatened to kill me (aggravated assault), and her brother sent their family friends who are police officers to threaten me. The threat being, “you better keep quiet.” The deputies (Lauren Kersh’s family friends) coming to my apartment was a continuation of Stephanie Lauren Kersh’s assault and threat to kill me. I didn’t know if they were going to arrest me, or put me in their Tahoe, drive me out to some field, and shoot me. We had just talked about Lauren Kersh pulling a gun on me and threatening to kill me, and they turn around and issue a criminal trespass warning against me, the victim.
I went along with everything they said hoping they would just leave. I spoke to them with my hands behind my back so they wouldn’t be able to claim they were threatened in any way. The video evidence alone proves that Lauren Kersh committed a violent crime and that I am the victim of that violent crime (she confesses on video). That these deputies did not arrest me proves that Lauren Kersh committed a violent crime against me. If I had done something bad enough to justify Lauren Kersh pulling a gun on me and ordering me to her porch, threatening to kill me, and questioning mat gunpoint, these deputies had to arrest me. They did not have a choice; they had to arrest me but they did not.
As deputies (police officers), they don’t have the right to go to the home of the victim of a violent crime and take a report against him or issue a criminal trespass warning. Lauren Kersh confessed over and over. Lauren Kersh didn’t call 911 in the first place because she couldn’t; she’s the criminal. The deputies had a duty to arrest Lauren Kersh but they couldn’t because she is their friend’s sister. So, I, the victim, had to become the criminal. The best that Lauren Kersh and her brother can come against me with is slander.
Even with all of their false statements and slander, they still don’t accuse me of any crime (no probable cause). Instead, they just make me appear to be a shady person. What they did to me at my apartment, they did under the threat of death. They wanted me to think that I may lose my life if I don’t cooperate with them. This is coercion, and at this point in the story, it is proven (if you have viewed the video evidence). It is proven by the fact that I am the victim of a violent crime and that Kersh is the attacker (both my word and Kersh’s words combined prove this). These deputies are my attacker’s family friends (proven on video evidence). This is coercion. The only way they are getting away with this is because they are on the honor system, and there is no one to hold them accountable.
Sheriff Chuck Edge June 11, 2019
On June 10, 2019, I was sent home from work (Detention Officer in the Ellis County Jail) with pay. Later that evening, I was called and told I had an appointment at the Sheriff’s Office on the following day (the 11th) with an investigator.
When I got there, I found out that my appointment was with the Sheriff and not an investigator. Ellis County Sheriff (Chuck Edge) fired me to make it look like I did something wrong as his deputies did not have probable cause to arrest me for anything (fraud).
Sheriff Chuck Edge fired me under Texas Government Code 614 (complaint against a public servant) listing himself as the complainant and not Lauren Kersh. Sheriff Chuck Edge could not fire me under 614 because I was a jailer (not a police officer), and my official capacity ends within the jail. I would have had to have done something wrong as a jailer to be fired under Texas Government Code 614. Since Sheriff Chuck Edge chose to fire me under Texas Government Code 614 anyway, an investigation was required by law before termination. An investigation would have made an official record (a report) of the assault against me as well as the fact that the Ellis County Sheriff’s deputies wrote reports charging the victim of a violent crime with stalking (and didn’t even arrest him). An investigation would have made a record of my side of the story.
To this day, there has never been an investigation of me (internal affairs or criminal). This investigation would have been used against Lauren Kersh, Joe Fitzgerald, Jerry Whitt, and Mike McKenna by making an official record of their crimes. Lauren Kersh had just been rehired but Sheriff Chuck Edge did not allow Lauren Kersh to return to work after she assaulted me. She wasn’t allowed back because she committed a violent crime and she can’t be trusted with a gun. Sheriff Chuck Edge could not give a reason for my termination. He states in his termination letter that I went to Lauren Kersh’s house and that could be considered a crime, but does not say why. The Sheriff, just like his deputies, suggests that I’ve done something wrong because they don't have the probable cause to say that I’ve done something wrong.
So, Sheriff Chuck Edge was trying to make me out to be a creep. The Sheriff asked me if I went to Lauren Kersh’s house, and I said, “yes.” He exclaimed, “So, you admit it” as if I had done something wrong. I didn’t confront Sheriff Chuck Edge about Lauren Kersh pulling a gun on me because I didn’t know what was going on. (I was confounded.) I felt like Lauren Kersh had just made a mistake and I didn’t want to throw her under the bus outright. I turned it around on the sheriff completely by telling him what his deputies did to Kersh. Lauren Kersh had been in a pornography video when she was younger, and nearly all of the Sheriff’s deputies watched her video at work and on County property (they brag about this).
They went to the jail (where she worked) and told all the jailers about it and where they could watch the video. They made fun of her because she had been with black people and she had a mixed-race son. I told Sheriff Chuck Edge about his deputies sexually harassing Lauren Kersh for the four years she worked there. So, I protested the Sheriff and the deputies who took their false reports against me and fired me (the victim). I gave him the names of the deputies who harassed Lauren Kersh. I told the sheriff how his deputies watched Lauren Kersh’s pornography video at work while being paid by the taxpayers and on County property (the County training building). I told the sheriff how the same deputies went out of their way to go to the jail and tell all the jailers all about her past. Sheriff Chuck Edge said he would look into it and fired me. Captain Tommie Eberhart of the jail witnessed this conversation between Sheriff Chuck Edge and me.
June 14, 2019 The Other Deputies
After Sheriff Chuck Edge fired me, the deputies who I reported to Sheriff Chuck Edge for sexual harassment waited for me across the street from my gym. I know it was them as we all used to work out at this gym and it was at this gym that these deputies openly harassed Lauren Kersh by talking about and making fun of her past to other Ellis County Sheriff’s Office employees, including myself, while on duty and in uniform. As I pulled up to the red light next to my gym, two Ellis County Sheriff’s Office Tahoes were waiting in the parking lot at the gas station across from my gym. As I stopped at the light, they began to drive slowly. One Tahoe drove across the front (in front of) of my car and the other drove by my driver's side door. They made it obvious that they were trying to scare me by driving unusually slow (creeping).
Second Meeting with Sheriff Chuck Edge - June 17, 2019
I protested the harassment of the Sheriff’s deputies by visiting Sheriff Chuck Edge a second time regarding his deputies sexually harassing Lauren Kersh. I asked him how his investigation was going; he didn’t answer. I again told him the story along with all of the names and details of how his deputies sexually harassed Lauren Kersh. I didn’t have any new details to add; I was just there to remind him that I was still here and that he and his pervert deputies are trash.
Sheriff Chuck Edge stated that he didn’t think Lauren Kersh should have been allowed to work there in the first place. The only thing Sheriff Chuck Edge asked me was why I didn’t go on record with the Waxahachie Daily Light regarding Johnny Brown.
The Other Deputies (again) Late June
About a week later the same two deputies waited for me across the street from my gym again. They did this the exact same way. As I pulled up to the red light they began driving slowly (creeping). One drove across the front of my car and the other drove by my driver's side door. At this point, I had the Sheriff and two groups of deputies messing with me.
My Misunderstanding June 2019 - February 2020
The misunderstanding was that I believed that Sheriff Chuck Edge and his deputies (Jerry Whitt and Mike McKenna) were responsible for the false reports (and later arrest) and that Lauren Kersh and Joe Fitzgerald went along with them to keep from being charged with assault. I reasoned that Jerry Whitt and Mike McKenna were more motivated to “get me” because I went to the newspaper about their beloved Johnny Brown.
I figured Sheriff Chuck Edge viewed the videos and heard my comments about going to the newspaper and didn’t like it (I still figure this). The point is that I thought that Sheriff Chuck Edge was the driving force behind this when it was really Joe Fitzgerald and Lauren Kersh. So, I wasn’t gung-ho in pursuing charges against Lauren Kersh believing that she and her brother were good people who made a mistake, however, I wasn’t willing to be their fall guy either. My thoughts about Lauren Kersh and her brother were that the three of us needed to come to some kind of understanding about this because I got fired for no reason when Lauren Kersh is the criminal. According to my limited understanding of what was going on, they needed to help me get my job back, and Sheriff Chuck Edge needed to take the fall (the bigger criminal).
It wasn’t until eight months later (January 2020) when I viewed the evidence for the first time that I realized that Lauren Kersh and her brother, Joe Fitzgerald, were the driving force behind this. They planned the false reports (and arrest), and Sheriff Chuck Edge and his deputies were helping them. So, the misunderstanding was that I thought that Lauren Kersh and Joe Fitzgerald were good people who just made a mistake.
